Driver responsible for Karachi’s Karsaz Road accident sent to jail on 14-day judicial remand

A Karachi city court on Wednesday sent a driver to jail on a 14-day judicial remand over a deadly accident that killed two people earlier this week.

On Monday evening, Natasha Danish’s speeding Toyota Land Cruiser collided with three motorcyclists and another automobile before flipping on Karsaz Road. Imran Arif, 60, and his daughter Amna, 22, were killed in the tragedy, while three others were injured.

The driver was then apprehended and charged with manslaughter.

However, on Tuesday, police failed to deliver the suspect in court because she was receiving mental treatment at the Jinnah Postgraduate Medical Centre (JPMC) while in jail. The investigation officer (IO) requested a 14-day police detention for the defendant, but the judge only granted him one day in police custody.

Following the court’s orders, the suspect was brought before a District East judicial judge today, where the police sought her again on a 14-day detention.

The suspect was released from JPMC’s mental unit, and the police brought her before the court.

The complainant in the case, Imtiaz Arif, was present at the hearing with his attorney, Barrister Aziz Ghouri.

One of the accident victims, whose Honda Civic was damaged, also appeared in court.

During the hearing, the suspect’s attorney contended that the charges against her client were bailable.

At this point, IO Rehan Ahmed informed the court that the charge of section 322 (penalty for qatl-bis-sabab) of the Pakistan Penal Code had been added to the case, which he described as a non-bailable offense.

A victim’s attorney then sought for an investigation into the “kind of drug” that the defendant was allegedly under the influence of at the time of the tragedy.

The judge then asked the suspect for her husband’s name, to which she replied. When asked if the cops tortured her, she said no.

The court then sent the suspect to jail on a 14-day judicial detention and ordered the IO to provide a charge sheet at the next hearing.

The FIR

The FIR, a copy of which is accessible on Dawn.com, was filed at 11 p.m. last night at the Bahadurabad police station on the complaint of Imtiaz Arif, whose brother and niece were killed in the accident.

The FIR used sections 320 (penalty for qatl-i-khata by rash or negligent driving), 337-G (punishment for harm by rash or negligent driving), 279 (rash driving or riding on a public route), and 427 (mischief causing damage to the sum of fifty rupees) of the Pakistan Penal Code.

According to the complaint, Arif was notified at about 6:45 p.m. on Monday that his brother Imran Arif, who was riding a motorbike with his daughter Amna Arif, was involved in an accident.

When the complainant arrived at the JPMC, he saw that the suspect, driving a Toyota Land Cruiser, had rear-ended his brother’s motorbike.

“Abdussalam, son of Mohammad Ishaq, who was riding on the motorcycle, was also injured,” the FIR alleged, adding that Imran and his daughter had many injuries and died subsequently.
